Cairn Energy wins $1.2bn case against India in tax arbitration case

  • London listed Cairn Energy Energy announced its victory in an international arbitration case against the Indian government over a tax dispute that had caused concern among investors over retrospective tax claims on companies
  • The tribunal ruled unanimously that India had breached its obligations to Cairn Energy under the U.K.-India Bilateral Investment Treaty and awarded Cairn Energy damages of $1.2bn plus interest and costs
  • For India, this is the second setback after losing another international arbitration case in September against Vodafone over a $2bn retrospective tax dispute
